Ordering

Ordering on the Domum Interior webshop is easy. You go to the page of your product of choice and click on “add to cart”.
Once you have finished adding products, click on the shopping cart symbol at the bottom right of your screen.
You can then enter your details, select a delivery method and pay in a few steps.

Immediately after completing your order, you will receive an automatic confirmation by e-mail. Your order will then be processed by us. We will inform you as soon as possible about the exact delivery date of your product(s). The expected delivery date is always indicated with the article on our website. As soon as your order is ready for shipment, you will of course be informed.

General conditions of sale

General terms and conditions for distance selling

Scope of application
These ” general terms and conditions for distance sales ” apply to sales contracts concluded remotely between Domum Interior, whose registered office is located at Kogelstraat 21, 1000 Brussels and its shop at Brakelsesteenweg 552, 9400 Ninove, and its customers. In addition to these ” general terms and conditions for distance sales “, specifically for sales concluded exclusively via the Internet and/or at a distance, there are the ” general terms and conditions for in-store sales “. The general terms and conditions of distance sales apply when the parties have exclusively used one or more remote communication techniques up to the conclusion of the contract, including the conclusion of the contract itself. Otherwise, the general terms and conditions for in-store sales shall apply. The customer’s order via the Internet site is only possible if, by a click, the customer accepts the ” general terms and conditions of distance sales “, which take precedence over all other terms and conditions.

Catalogue Webshop
Although great care has been taken in the development and updating of the webshop, the catalogue inevitably shows differences compared to the actual articles, particularly in terms of colours. A listing in the catalogue does not necessarily mean that the item is available. Domum Interior declines all liability in the event of inaccuracies, errors or omissions in the catalogue, except in the event of gross negligence or fraud.

Price
The prices shown on the webshop are:
• exclusive of VAT
• exclusive of assembly and installation of the furniture
• with delivery to the shop located at Brakelsesteenweg 552, 9400 Ninove (and therefore transport costs not included)
All taxes, duties and surcharges of any kind owed as a result of the sale in addition to the settlement price including VAT shall be borne by the customer.

Payment methods
For purchases via the Webshop, the customer chooses the following means of payment:
Direct payment by bank card or credit card

Down payment
If the customer chooses to pay an advance for a product made to measure or according to the customer’s specific wishes, he pays 50% of the price including VAT. For already fully finished products, the purchase price must be paid in full. If the client fails to execute the contract within 12 months, the deposit remains due to Domum Interior.

Payment
Invoices or debit notes are payable at Domum Interior’s shop at Brakelsesteenweg 552, 9400 Ninove. Goods are payable at the time of ordering via the Internet or in cash. In the event of an order, the balance not covered by the deposit shall be paid at the latest when the goods are collected in the shop or at the depot by the client. In case of delivery by Domum Interior or via a carrier, the balance of the price is paid before delivery. All sums remaining unpaid on the due date shall be increased, ipso jure and without notice of default, by annual interest of 10% and damages of 15% of the sums due, with a minimum of EUR 200, to be increased by the costs and fees of recovery.

Proof
The express agreement between Domum Interior and the client, and the emails constitute proof between the parties, as do the systems of automatic registration used by the Webshop, in particular regarding the nature and date of the order. The client can access the electronic contract he has concluded by sending an email to info@domuminterior.com

Delivery times
Unless otherwise stated on the webshop or on the order summary, the delivery time is 10 weeks. It starts to run the day following the day of payment of the purchase price or deposit. The contractual delivery time can be extended by 25% by the seller. It is extended by the duration of the annual supplier shutdown or by the duration during which performance is impossible due to force majeure.

Delivery
In case of ordering via the webshop, the customer has the choice between two delivery options.

Free collection by the customer from Domum Interior at Brakelsesteenweg 552 9400 Ninove.

Delivery by Domum Interior or by a transport partner.
Upon receipt to or production of the ordered goods by Domum Interior, Domum Interior will send the customer an arrival notification by e-mail, informing him of the fact that the good is available for collection. Domum Interior’s obligation to deliver the good is fulfilled by sending the arrival notification. The customer is obliged to collect the item within 30 days of receiving the arrival notification.

For orders for delivery in Belgium, the cost is free, provided that it is on the ground floor or a floor when there is a sufficiently spacious lift and without assembly of the furniture. For furniture delivery in the other European countries, these are based on an agreed quote between Domum Interior and the client.
It is up to the client to check whether there is an access route for the ordered items to the place of delivery. If there are obstacles to delivery, the client may ask Domum Interior or a carrier to provide a specific quote for this.

Depending on the quantity & weight & size, the deliveries of furniture ordered via the Internet are made by Domum Interior or partners specialised in furniture delivery. The deadlines are on average longer than those announced by shops working exclusively via the Internet. The delivery time shown on the summary of the order form or webshop is therefore purely indicative.
Domum Interior or its partners will contact the client to set a day and time for delivery.

If the carrier is unable to deliver on the agreed date due to the client’s absence or due to unforeseen obstacles, the client may be required to pay additional delivery costs.
Delivery of several items
Items ordered in the same shopping cart will in principle be delivered in one delivery, on the availability date of all the products ordered. In case of split shipping, the costs will also be split.

Assembly
The assembly of the furniture is neither included in the delivery nor in the delivery costs.
Retention of title
Ownership is transferred only after full payment of the sales price and costs and accessories.

Transfer of risk
The risk of accidental damage or loss of the goods is transferred to the client from the moment the goods are collected by the client or by the carrier chosen by the client. When the order form stipulates that the good will be delivered by Domum Interior, these risks are transferred to the customer from the time of delivery.

Final sale
The order is concluded on the client’s behalf from the moment he will have confirmed it. For Domum Interior, the order is closed as soon as payment has been validated and the order has been confirmed.
Once the sale is completed and definitive, the parties may no longer cancel or annul it, except in the event of a party being in default as indicated below, and without prejudice to the legal right of withdrawal provided for sales concluded exclusively by one or more distance communication techniques.

Right of withdrawal
The customer who is a private individual has the right to withdraw from the contract without any reasons. This right of withdrawal is valid for 14 calendar days from the day after delivery of the goods or taking physical possession of the goods. The customer has no right of withdrawal for goods manufactured to his specifications. To exercise the right of withdrawal, the purchaser must notify Domum Interior, rue du Bullet 21, 1000 Brussels, of its decision by registered letter.
If the right of withdrawal is exercised, the client shall return the complete goods, in good condition and in their original packaging, within one month of sending his/her decision of withdrawal. Shipping costs (the amount of which is equal to the delivery costs) will be borne by the customer. Domum Interior will assign a carrier to take back and transport the goods. It will refund the customer, less the shipping costs, within 30 days of taking back the goods. The refund will follow the same payment procedure used by the customer.

Complaints – guarantees
The client undertakes to examine the goods delivered as soon as possible to check that they do not present any apparent defect or that they were not damaged during transport. Should a problem or apparent defect arise during unpacking or assembly, for example in the client’s home, the client must inform Domum Interior as soon as possible by email at info@domuminterior.com or by letter addressed to Domum Interior, Kogelstraat 21 1000 Brussels and must indicate all elements (description, photo, etc.) proving the apparent problem or defect. The goods are considered accepted and approved by the client if he has not sent an e-mail or letter of complaint 7 calendar days after delivery. Except in exceptional circumstances that the customer can legitimately invoke, no complaint can be received after this period based on an apparent defect or damage. This clause does not affect the legal guarantee for lack of conformity and for hidden defects. When a conformity defect or hidden defect occurs, the client must inform Domum Interior, Kogelstraat 21 1000 Brussels in writing within two months of its discovery. Domum Interior provides the legal guarantees provided for in the mandatory provisions of Belgian law on goods sold, but only to the extent that the client has fulfilled his contractual obligations. As a general rule, the guarantee is valid for two years after the delivery date. The customer must present his cabinet ticket, order form or the invoice.

Delay in delivery
If the seller exceeds the contractual delivery time by more than 25%, and except in cases of force majeure on Domum Interior’s part, the customer is entitled to cancel the contract in accordance with the law. To do so, he shall send a registered letter to Domum Interior at its registered office Kogelstraat 21 1000 Brussels. Cancellation is possible on condition that Domum Interior has not yet delivered the goods or made them available to the client. The deposit or price transferred by the client will be refunded to him within 30 days to the bank account he will indicate.
This does not apply to custom-made furniture or works to be carried out.

Failure to collect
If the customer, after being notified by registered letter of default to remove the good within a deadline of 15 days, still fails to fulfil his obligation to collect the good, Domum Interior will be entitled :
• either pursue the execution of the sale in court
• or terminate the sale at the customer’s expense, by sending a registered letter stating the customer’s failure and the termination of the sale.
In case the rescission is founded on the customer’s failure to perform his obligation to collect the good, a compensation of 30% of the amount of the good will be due. The compensation will be 75% of the amount of the good, if it concerns goods manufactured to measure or according to specific wishes of the customer.

Force majeure
Either party will be able to invoke force majeure to temporarily or permanently suspend the performance of its obligations. War, mobilisation, strike, lock-out, breakdown of machinery, fire, explosion, energy supply problems, interruptions of means of transport or any exceptional event preventing or hindering the manufacture, transport or sale of the good are conventionally considered cases of force majeure, whether they occur at the seller, its subcontractors or the supplier.

Additional cost or cancellation in the event of unforeseen or unknown circumstances and/or elements
If any unforeseen circumstances or changes to any elements occur during the quotation/proposal phase or during the manufacture of the furniture and/or customised work or its installation at any time and are not communicated in advance in writing or by e-mail by the client/buyer/customer and Domum Interior is unaware of them, they may result in additional costs or the cancellation of the order, quotation or sale of the furniture/customised work whereby the client must reimburse Domum Interior for any costs incurred.

Liability
Domum Interior’s liability shall not be incurred except in the event of fraud or gross negligence on its part or on the part of its employees. Even if Domum Interior were to be liable for compensation, this will always be limited to direct damage suffered personally by the client. Indirect damages are not eligible for compensation.

Respect for private life

In accordance with the provisions of the GDPR legislation and the law of 8 December 1992 on the protection of privacy in relation to the processing of personal data, the client expressly authorises Domum Interior to register in a file and process all personal data obtained about the client. The personal data provided in these circumstances are exclusively for internal use, commercial use and marketing. If the customer wishes to oppose this, it is sufficient to send a letter to Domum Interior, clearly stating his/her name and full address. The client may at any time access the file containing their personal data, in order to take note of it or make any corrections. It suffices to send a letter to Domum Interior stating his name and address. Personal and individual data will never be rented or sold to third parties.

Safeguard clause

In the event that any of the provisions of these general terms and conditions should be deemed null and void or inapplicable, the other provisions shall continue to apply.

Change of domicile

The customer shall inform Domum Interior of the change of his domicile.

Applicable law – competent court

Belgian law is applicable to this contract. In the event of proceedings, the Dutch-speaking courts of Brussels shall apply.

General terms and conditions for in-store sales

Scope of application
These general terms and conditions apply to contracts other than concluded at a distance between Domum Interior, whose registered office is located at Kogelstraat 21 1000 Brussels and/or its shop located at Brakelsesteenweg 552 9400 Ninove, and its customers. In addition to these ” general terms and conditions for in-store sales “, there are the ” general terms and conditions for distance sales “, specifically for sales concluded exclusively via the Internet or at a distance. The general terms and conditions of distance sales apply when the parties have exclusively used one or more remote communication techniques up to the conclusion of the contract, including the conclusion of the contract itself. Otherwise, the general terms and conditions for in-store sales shall apply. The confirmation of the order or the signature of the purchase contract by the customer entails the unreserved acceptance of these general conditions of sale, which take precedence over all other conditions.

Price
Unless otherwise agreed in writing between the parties, prices are:
• including VAT
• excluding assembly and installation of the furniture
• with delivery to the shop located at Brakelsesteenweg 552 9400 Ninove (and therefore transport costs not included).
All taxes, duties and surcharges of any kind owed as a result of the sale in addition to the price including VAT shall be borne by the customer.

Down payment
On the occasion of each order, the customer pays the full amount of the price incl. VAT. If it concerns a product made to measure or according to specific wishes of the customer, he pays an advance of at least 50% of the price incl. VAT. In the absence of performance of the contract by the customer within 12 months of the order, the advance remains acquired by Domum Interior.

Payment
Invoices or debit notes are payable at Domum Interior’s shop at Brakelsesteenweg 552 9400 Ninove. The goods are payable in cash. In the event of an order, the balance not covered by the deposit shall be paid at the latest when the goods are collected from the shop or by the carrier of its choice. Unless otherwise stated in writing on the order form, the client organises, at his/her own expense, the collection of the goods and/or their dispatch from Domum Interior’s shop or depot. The client chooses his carrier. He is free to choose a Domum Interior partner carrier acting independently. Even if the order form stipulates that the good will be delivered by Domum Interior, the delivery does not include assembly.

Retention of title

Should a problem or visible defect occur during unpacking or assembly, for example in the client’s home, the client must inform Domum Interior as soon as possible by email at info@domuminterior.com or by letter addressed to Domum Interior, Kogelstraat 21 1000 Brussels and must indicate all elements (description, photo, etc.) proving the visible problem or defect. The goods shall be deemed accepted and approved by the client if he has not sent an e-mail or letter of complaint 7 calendar days after delivery. Except in exceptional circumstances that the customer can legitimately invoke, no complaint can be received after this period based on a visible defect or damage. This clause does not affect the legal guarantee for lack of conformity and for hidden defects.
When a conformity defect or hidden defect occurs, the client must inform Domum Interior, Kogelstraat 21 1000 Brussels in writing within two months of its discovery. If the client, after being served with a notice of default by registered letter to remove the good within a deadline of 30 days, still fails to fulfil his obligation to collect the good, Domum Interior shall be entitled :
• either pursue the execution of the sale in court
• or cancel the sale at the client’s expense, by sending a registered letter stating the client’s failure and the cancellation of the sale. In case the rescission is founded on the customer’s failure to perform his obligation to collect the good, compensation will be due equal to the advance payment, but with a minimum of 30% of the price of the good. However, the compensation will be equal to the amount of the advance, with a minimum of 75% of the price of the good, if the goods are manufactured to measure or according to specific wishes of the customer.

Force majeure
Either party will be able to invoke force majeure to temporarily or permanently suspend the performance of its obligations.
